THIS IS A MEMBERSHIP AGREEMENT between The Huntsville Gym (the “Club") and you, the undersigned client. The Huntsviiie Gym agreeing to finance your Membership Agreement based upon the terms and conditions contained in this Agreement. By signing below, you represent to The Huntsville Gym that you are at least 18 years of age and, that you have read and understand this Agreement, and that you agree to its terms.

RENEWAL STATEMENT
Provided that the member is not in default of this Agreement and subject to the terms and conditions hereof, the membership will automatically renew for the rate indicated below. Renewal terms may be cancelled at any time provided a 30 day email notice is delivered to info@thehuntsvillegym.com. It is also understood that the club has the option to increase monthly renewal use without notice during any period not to exceed 5%.

RELEASE OF LIABILITY/ASSUMPTION OF RISK/BUYERS RIGHT TO CANCEL
The Huntsville Gym , which includes its officers, directors, and agents, urges a|l members to obtain a physical examination prior to the use of any exercise equipment or participation in any exercise class. I am aware that there is an element of risk of injury or death associated with activities performed in furtherance of physical fitness, martial arts training, or other related activities that are available at The Huntsville Gym. I accept the risk of such activities and undertake them on my own responsibility. I am aware that such activities are recreational in nature, and after reading and understanding this document, I choose to participate voluntarily. In consideration of the permission to participate extended to me and for the services furnished to me by The Huntsville Gym, I hereby for myself. my heirs, personal representatives and agents, release and forever discharge any and all claims, demands, actions, lawsuits on account of my injury or my death that mipht occur as a result of negligent conduct during my participation of activities while at The Huntsville Gym and its licensor If by reason of death or permanent disability, I am unable to participate in physical activities at The Huntsville Gym, my estate shall be relieved of any obligation to make payment for training other than that prior to the death or order of disability. If any part of this waiver is invalidated by a court of law then the remainder of this waiver shall remain in full effect. If you wish to cancel this contract without penalty, you may do so b\' delivering or mailing a written notice to The Huntsville Gym. The notice must say that you do not wish to be bound by the contract and must be delivered or mailed before the third business day after you sign this contract. The notice must be mailed or hand delivered to: The Huntsville Gym, 3070 Leeman Ferry Rd SW. Huntsville, AL 35801.
NOTICE: Any ho|der of this Agreement is subject to all claims and defenses which the debtor could asset against the seller of goods or services obtained pursuant hereto or with the proceeds hereof, recovery hereunder by the deotor shall not exceed amounts paid by the debtor hereunder.
ADDITIONAL TERMS AND AGREEMENTS

In addition to terms in this agreement, all signs or notices placed in the Club shall be considered as rules and regulations of the Club which all Members must follow. The Club may also adopt additional rules and regulations at any time in its sole discretion. Any notice to Members shall be considered duly given when either personally delivered or mailed to the Member at the address on the membership agreement, or if posted in the Club.

Membership cards are issued to Members only. Memberships are non-transferable any may not be sold, advertised for sale, assigned, or transferred without the prior written permission of the Club. Membership cards may not be loaned to anyone, and memberships are non-voting. Violation of this rule may result with immediate expulsion from the Club. The membership card is Club property.

The Member is responsible to timely pay all contracted membership dues and fees in this agreement with the following exceptions;

If the Member provides written proof that he/she has moved more than 15 miles from any existing facility, the Member shall be relieved from further obligation under this agreement; however, Member shall be charged a $100 cancellation fee during the first 1/2 of the term, or a $50 cancellation fee during the second 1/2 of the term. Unused or pre-paid sessions are non-refundable.

Upon written proof being provided to the Club of the Member's death or permanent disability of which prevents the Member from ever again using the facilities (verified in writing from a physician), the Member or his/her estate shall be relieved from further obligation under the terms of this agreement (other than those received prior to proof of death/disability being provided to the Club.

Except for the terms of this agreement other charges or fees for services and facilities are subject to change in the sole discretion of the Club.
S. In the event of a temporary or permanent Club closure for any reason, the Club in its sole discretion may transfer this membership agreement to any other facility within 25 miles of the closing Club for the remainder of the membership term or any other temporary period of time.

Any Member who is loud, offensive, or bothersome to other members or Club staff may be suspended or expelled from the Club. In the event of such suspension or expulsion, the unused portion of any prepayment or advanced payment by the Member shall be forfeited to the Club.

The hours of operation are posted at the Club and are subject to change by the Club.

There will be no smoking on the Club premises at any time.

All Members and guests must register at the front desk before entering the Club. All guests must execute a waiver/release of liability and indemnify agreement, and all guests must pay the designated guest fee established by the Club. All guests must follow all rules and regulations of the Club. Former members and members restricted from the Club may not enter as a guest. Members are responsible for their guests.

Members must present membership cards each time they enter the Club. Until new Members receive their membership cards, Members must show their photo ID along with a copy of their membership agreement.

Club services may only be used by Member's in good standing. A Member whose membership has expired or is in default may not use the Club's facilities.

There shall be no solicitation in the Club or in the parking lot.

Members must wear shirts (covering the chest and back) at all times in the Club.

Footwear, i.e. tennis shoes or aerobic shoes, must be worn at all times in the exercise areas as well as the entire Club. Open toed footwear is not allowed.

Members must be properly attired in standard workout clothes, i.e. leotards, gym shorts, jogging shorts (while in the exercise areas).
-
There shall be no yelling, screaming or profanity in the Club.

It is recommended that Members consult the Club's fitness professionals for proper use of the equipment.
-
Please return weights to the proper racks when finished.
-
It is the responsibility of the Member to use a spotter when using heavy weights.
-
There should be no littering or leaving debris on the gym floor.
-
Members who sweat profusely should use towels to clean up the gym equipment when they are done using the equipment.
-
The Club retains the right to increase monthly dues to include the amounts of any future increases in state sales tax.

No dropping the weights.
-
No hair dyes shall be used at the Club; no shaving in the saunas.

Eating and drinking is only permitted in the lounge. Please do not eat or drink in the locker rooms or spa areas.
-
Belongings may not be left in daily lockers overnight. Locks will be cut off and contents removed.

The Club has no responsibility for items removed from lockers.
-
No personal belongings (i.e. gym bags, purses, extra clothing, etc.) are allowed on the workout floor.
-
Chalk is allowed only in designated areas.
-
No member shall perform personal training services on the premises, nor shall any member solicit such services from anyone who is not an employee of the Club. No member shall bring any individual to the premises to perform personal training services.

The Club reserves the right to refuse anyone who is not properly attired, personally clean, or acting inappropriately.

Children under the age of 12 are not permitted in the Club unless directly supervised by a parent, guardian, or personal trainer. Children 12 years old or older may become a member so long as their parent or legal guardian execute all necessary membership agreements and/or other required documentation.

The Club may establish fees for any lost or damaged membership cards.

Member must sign for each session at the time of workout.

The Club reserves the right to provide a substitute trainer in the event that the original trainer is unable to conduct the workout for any reason. The substitute trainer will be certified in Personal Training.

A 24-hour cancellation is required; otherwise the member will be charged for the missed session.

The terms and conditions of this agreement expire at the date stated on the front of this agreement. After the expiration date the Club reserves the right to terminate this agreement regardless of unused sessions.
